Raipur: The Supreme Court has set aside a ₹1 lakh fine imposed on the Chhattisgarh Medical Services Corporation (CGMSC) by the Chhattisgarh High Court, upholding the agency’s tender process and operational guidelines.
The matter originated from a petition filed by a contractor in the High Court regarding a tender dispute. Following the High Court’s decision to levy a ₹1 lakh cost on the corporation, CGMSC challenged the verdict in the Supreme Court.
During the hearing, the Supreme Court observed that CGMSC committed no procedural error. The court noted that all relevant information and official communications were sent to the email address provided by the contractor in the application form within the stipulated timeframe.
The contractor failed to respond within the deadline, resulting in disqualification as per the established rules.
Setting aside the penalty, the apex court ruled that CGMSC acted within its regulatory framework and held that the fine was unwarranted.
CGMSC officials stated that the corporation will continue efforts to strengthen health services across Chhattisgarh while adhering to standard procurement guidelines.
