Chhattisgarh on Thursday introduces stringent Chhattisgarh Dharm Swatantra Adhiniyam 2026, aimed at curbing illegal conversions through force, allurement, or digital means. This legislation replaces the outdated 1968 Act, emphasizing prior declarations, inquiries, and severe penalties to safeguard religious freedom.

Bill Overview

The bill prohibits conversions induced by glorification, misrepresentation, coercion, undue influence, allurement, fraud, or marriage, extending to digital platforms like social media. It defines “illegal conversion” broadly, covering renunciation of traditional customs or ancestral worship, but exempts reversions to original faith. Applicable statewide, it activates via government notification, with special protections for minors, women, Scheduled Castes/Tribes, and Other Backward Classes.

Key Procedural Provisions

Intending converts must submit a prior declaration to the District Magistrate (competent authority), published online and locally for 30-day objections. The authority conducts inquiries with civil court powers, deciding within 30 days; appeals go to the Principal District Judge. Post-conversion, a certificate issues after verification, lapsing if not completed within 90 days.

Marriage and Assistance Rules

Marriages between faiths require 60-day prior declarations if conversion is involved; non-compliance deems them illegal. Converters and assistants must register, maintain records, and file annual reports on conversions and foreign funds, banning external donations for conversions. Reversions to original faith need reporting for certificate cancellation.

Penalties and Enforcement

Violators face 7-10 years imprisonment and ₹5 lakh fines, escalating to 10-20 years or life for mass conversions, vulnerable groups, or repeats. Offences are cognizable, non-bailable; Special Courts and Prosecutors ensure speedy trials within six months, with victim compensation up to ₹10 lakh. Burden of proof lies on the converter.
