Bilaspur:The Division Bench of the High Court of Chhattisgarh has dismissed the writ appeal of Chhattisgarh government and directed the government to pay the dues of MISA detainees for the intermediate period until the scheme was withdrawn.

The Division comprising Justice Narendra Vyas upheld the Single Bench judgment. The State government has challenged the Single Bench judgment which had asked the state government to pay the dues for the intermediate period till the date of notification issued for the withdrawal of the honorarium scheme introduced by the state government for MISA detainees. The Single Bench was of the view that the scheme was launched by the state government not by Congress or BJP and therefore the MISA detainees are entitled for the benefits, said advocate Tiwari.

It is to be mentioned, the pension/honorarium of MISA detainees, which was introduced by the state government in 2008, was stopped by the state government from January 2019.

Meanwhile, former Chief Minister Dr Raman Singh sees the decision of the Double Bench as a victory of democracy and a lesson for Congress. Dr Singh said that the High Court of Chhattisgarh has passed the historic decision. The BJP government had taken an important decision in favour of MISA detainees in 2008. The way they were harassed and made to serve 19 months jail term was an inhuman act. They lost their livelihood.

To provide them relief, BJP government of Chhattisgarh had decided to give honorarium to the families of MISA detainees who were also called as Loktantra Senani, but the Congress government withdrew the scheme in 2019 against which MISA detainees had moved the court. The Single Bench of the High Court gave judgment in favourof the Senani. The state government had challenged the decision in the Division Bench of the HC through a writ appeal, but the Double Bench upheld the Single Bench judgment, said Dr Singh.
