Chhattisgarh High Court imposes ban on land acquisition for Parsa coal block

High Court has issued directions to the Central and State Governments to
maintain status quo till the next hearing of the matter, while imposing a ban
on land acquisition of Parsa coal block.

The petition challenging
the land acquisition action for the Parsa coal block was heard in the High
Court on Monday. The division bench comprising of Chief Justice Arup Kumar
Goswami and Justice NK Chandrawanshi issued directions in this regard.

The petition states
that 1250 hectares of land has been acquired for Parsa coal block. In this,
about one-third of the land belongs to tribal farmers. The remaining two third
of the land is dense forest, which apart from being an elephant affected area,
is used by all the nearby villagers for minor forest produce collection.

The petition states
that the Rajasthan Corporation has entered into an agreement to hand over the
Parsa coal block to a company owned by Adani for mining. That is, this land
acquisition is in the interest of the private company, for which the Coal
Bearing Areas (Acquisition and Development) Act cannot be implemented. Along
with this, it has also been said in the petition that the notification of
Section 4 and Section 7 related to acquisition was not made available to the
affected farmers in time. On the objections sent by the affected people, the
Coal Controller neither gave an opportunity of being heard nor resolved the
objections.

The next hearing of the
case will be on January 8.
